      The State of Indiana Madison County Ind
      Personally appeared in open court
      before the Honorable James Scott sole Judge of the Probate
      Court of County of Madison, now, sitting, Samuel Pavey
      a resident of the County of Madison aforesaid, aged
      72 years in July last, who being first duly sworn
      according to law. doth on his oath make the following
      declaration, in order to obtain the benefit of the act
      of Congress passed June 7, 1832. That in Guilford
      County in the state of North Carolina he volunteered into
      the service of the United States for the term of 18 months,
      and was rendezvoused at Guilford Courthouse, on the 10
      day of August; And he thinks in Aug 1781, being in August
      previous to the battle of Eutaco Springs - From Guilford
      he was immediately marched under Captain Smith Moore,
      a militia Capt. to Salisbury, where, as a private soldier,
      he was put into a company of North Carolina State troops
      (as he now thinks) under Captain _ytle, in which compa-
      ny one Campbell was Leut. and Hawler was the order-
      ly sergeant in a regiment under Col. Archibald Ly_
      tle, While the troops with which this declarant ser-
      ved lay at Salisbury he was sent in company with
      a Sergeant William Hamilton, in pursuit of a deserter
      whom they followed back to Guilford Court house and
      on to Deep river but being unable to retake him, after
      a pursuite of or days they returned to their
      quarters. Late in October ensuing his enrollment being
      upwards of two months after his arrival at Salisbury
      he was marched under the officers last afresaid to
      Ashley hill where the North Carolina troops joined
      General Green's Army and was immediately marched
      thence to James Island near Charleston, South Carolina.
      He well recollects that on his march to James Island
      the Army encamped at the Old Eutaw fields, was also
      at Camden, being after _ates' defeat at the Tatten place
      and the destruction thereof by fire. The declarant was
      quartered for a considerable period of time on James Island
      at which place and in the immediate vicinity of
      Charleston he continued until after the surrender of
      Lord Cornwallis at Yorktown, Va.

      His service in the neighborhood of Charleston consisted
      principally in surpressing insurrections among the disaf-
      fected inhabitants. He was dismissed from the service
      shortly after Cornwallis surrendered, making a period
      through which he served of 14 months, being from the
      tenth of August 1781 until after the aforesaid surrender
      which his is informed was late in Oct 1782.
      There are many minor incidents which the declarant might
      here relate that would doubtless tend in some degree to
      strengthen his declaration, but wishing to avoid unnecessary
      _______, he omits to mention them. He was in no battles
      during his tour of service; And for answer to the seve-
      ral XXXXXXX interogatories contained in the regulations
      of the war department for the purpose of carrying into
      affect the aforesaid Act of Congress, he says, 1st. He was
      born in Accomack County Virginia in 1761. 2nd. He has
      no record of his age. 3rd. When called into the service he
      was living in Guilford County, N. Carolina. For a number
      of years after the Revolution he resided in the State of Dela-
      ware, then in Kentucky, afterwards in Ohio, whence in
      1818 or 19 he moved to Morgan County, Indiana.
      He resided in the Counties of Morgan and Fayette until
      within 12 or 14 months past when he settled in the said
      County of Madison, his present place of residence.
      4th. He entered the service as volunteer. 5th. For the
      names of his officers and the general circumstances of
      his service he would refer to the preceeding part of this declara-
      tion. 6th. The declarant thinks he never received
      a written discharge XXX and if he did the same is
      lost. 7th. He would state that having resided in the
      in the said County of Madison not exceeding 12 or 14 months
      he has not formed such an acquaintances with any
      clergyman in the said County as would authorize XXX
      him to make a certificate for the declarant as
      XXXXXX is necessary under the requisitions of the war
      department to entitle the declarant to a pension, which
      fact induced the declarant to procure the certifi-
      cate of the Honorable B. F__orris Prest, Judge of the fifth
      Judical circuit in this state as also that of ___ Smith Esq
      late a member of Congress from said state, both of which

      *He has no dockumentary evidence and he knows of no person whose testimony he can procure who can testify to his survice XXX and

      are duly authenticated by the offical certificate of
      the Honorable Benjamin Park and are hereunto XXXXXXXX
      prefixed. The aforesaid certificates the declarant XX
      believes sufficiently establish his character for vera-
      city and his reputation in his former neighborhoods
      as a soldier of the Revolution. He hereby relinquish-
      es every claim whatever to a pension or annuity accept to
      present and declares that his name is not on the
      pension roll of any agency of any state or territory.

      the investigation of the matter, and after putting the inter-
      rogatories prescribed by the war department, and after
      a particular examination of the certificates of the Hon.

      ated by the Hon. Judge Parke as in the above declar-
      ation specified, XXXXXXXX (all of which XXXX appear
      to the Court to be ginuine) that the XXXX above named
      applicant is a revolutionary soldier and served as he
      states. All which is order to be certified by the
      Clerk of this Court accordingly.

      "It is thought that Samuel Pavey II was the father of John Pavy but has not been proven. I know that John's mother was named Sarah Pavey because she signed consent on his marriage bond. Samuel and Sarah were separated or divorced in Harrison Co., KY in 1802 according to court records.

      There is a lot of confusion regarding the marriages and children of Samuel Pavey II. There are records that he married a Heathy Kane and other records show that he married a Heathy Denny. It unknown if this the same person or two different people. Some records show that he had as many as 15 children with his different wives.

      Misc.: A Samuel Pavey (we think II) sold his land in DE to Isaac Pavey in 1787. . . by right of fee simple (inheritied land I found out) for L50. A Samuel Pavey had bought the same land in 1782 for L100 from Thomas Banning. Could it be that Samuel was the first one to migrate (to KY) after his father's death with Isaac Pavey following by 1800? Also, there was really a killer epedemic in and around Dover, DE in 1783. Could Samuel Pavey I died there then?"

      Although born in Virginia, he was residing in Guilford Co., North Carolina when he enlisted in the Army for service in the Revolutionary War, serving the last year or so of the war with North Carolina troops. Apparently he didn't stay around for a discharge because many years later (1833) his pension application was rejected on grounds that he was a deserter. After the war he resided in Delaware (with family in nearby Maryland), Kentucky, Ohio and finally in Indiana. He was said to have been married twice - first to Sarah (Hurst?); second to Hethy Cain. His wife Sarah left him about 1801 or 1802. Most likely he remarried after he left Kentucky.

      Pension Application Of Samuel Pavey, Nat'l Archives Series M804, Roll 1891 Application #R8017

      Madison County, Indiana, SAMUEL PAVEY, aged 72 years in July last:
      "That in Guilford County, in the state of NC,, he volunteered into the
      service of the United States for the term of 18 months, and was rendezvoused at
      Guilford Courthouse on the 10th day of August, and he thinks in August 1781,
      being in August previous to the Battle of Eutaw Springs."

      "From Guilford, he was immediately marched under Captain SMITH MOORE, a
      militia captain, to Salisbury, where as a private soldier, he was put into a
      company of North Carolina state troops (as he now thinks) under Captain LYTLE,
      in which company one CAMPBELL was lieutenant and _. LAWLER was the orderly
      sergeant in a regiment under Colonel ARCHIBALD LYTLE. While the troops with
      which this declarant served lay at Salisbury, he was sent in company with a
      sergeant WILLIAM HAMILTON, in pursuit of a deserter whom they followed back to
      Guilford Courthouse and on to Deep River, but being unable to retake him after

      "My old Friend, SAMUEL PAVEY, the person named in the enclosed paper,
      called on me just before I left home with this paper, and stated to me that his
      claim for a pension had been rejected by the department upon the ground as he
      understood, that it appears by the records and rolls in the possession of the
      department, that a man of his name under the same command deserted. The present
      applicant assures me (and I have no doubt whatever of the truth of his
      statement for I have known him long and believe him to be un_____able in
      character) that there were two of the same name under the command. The other he
      says he believes was a fifer, and he may have left the army, but this applicant

    6. [S151] Email - McWilliams, Marsha, (n.p.).
      I am trying to further document and add to the Family Group Sheet for Samuel Pavey II and am in hopes that there is someone who will be able to help me.

      According to his Rev. War Pension Application (R8019), Samuel Pavey was born in Accomac Co, VA, July, 1761 (as best he could remember.) He entered into the Rev. War in Aug., 1781, while living in Guilford Co, NC. He stated that after the war, he lived in DE, KY and OH before moving to Indiana (abt 1818.) His request was turned down due to desertion. (I have copy of the original application.)

      I believe Samuel Pavey was married 3 times and had at least 18 children.

      1st wife was probably Nancy SMITH. She was the daughter of Levin SMITH, Jr who died in Caroline Co, MD in 1782, leaving his land, "Levin's Folly" to his wife. Should his wife die or remarry (she remarried), then "Levin's
      Folly" was to go to his children. Levin Smith had only one daughter, Nancy. (This information is well documented in Levin's will and further court papers.) Sometime between Levin's death and Sept. 3, 1787, Samuel Pavey
      must have married Nancy...

      Caroline Co., MD Land Records, 3 September, 1787, Samuel Pavey of Sussex Co, DE sold "Levin's Folly" to Isaac PAVEY. Samuel said the land was his by estate of inheritance in fee simple. (Isaac Pavey was Samuel's brother.)

      "Samuel Pavey says his wife, Sarah Pavey left him and he won't pay her bills."

      pg. 16: Samuel PAVEY is summoned to court to show cause why Peter, Jesse, Sally and Polly, his children, should not be apprenticed out."

      Samuel Pevey - Hethy DENNY, married Dec. 25, 1804 (I have a copy of the original marriage book page on this marriage. Hethy's last name was Denny and not Cain as previously been reported for years. For those who would
      like an explanation for the mix-up, please contact me.)

      Samuel Pavey died Aug. 20, 1851 in Madison Co, IN and is buried in Crosely Cemetery, Falls Creek twp. along side of Hethy who had died pre-1850.
